On 9 February 2022, detained and on the same day taken into custody on the case of organisation of activities of a terrorist organisation and preparation for violent seizure of power in connection with the alleged involvement in the Islamist party "Hizb ut-Tahrir", which has nothing to do with terrorism. On 30 November 2022, sentenced to 17 years in a strict regime colony.
In June 2023, it became known that before the appeal Mustafayev was given only 15 days to familiarise himself with 7,300 pages of the case.
In 2025, he was deprived of Russian citizenship.
